The Hidden Story on the Florida Bar’s Metadata Position


Several months ago, I noted that the Florida Bar had decided to burn witches - urm, prohibit the mining of metadata.

Doing some metadata research today, I finally found the real reason the Bar acted so strongly - one of the members of the Board of Governors got suckered.

One Florida lawyer was quite upset when he learned his firm had been hoodwinked into e-mailing a document to opposing counsel instead of faxing it so that the metadata could be mined by opposing counsel. Apparently some client comments that were attached to the document and then deleted were recovered by opposing counsel. Well, this lawyer was on the Florida Bar’s Board of Governors…

There are few things as dangerous as a powerful person who’s been made to feel foolish.
